The Delhi High Court on Monday ordered SpiceJet and its Chairman and Managing Director (CMD) Ajay Singh to pay Sun Group Chairman Kalanithi Maran the remaining Rs 32.5 crore of dues by the end of the day or the next day, depending on banking hours.
Maran's attorneys stated that Singh had time from 24 August to now, but that the payment was postponed until now. Singh's attorneys informed the Court that they had a cheque in the amount of Rs 37.5 crore in favour of Maran, having already paid Rs 62.5 crore.
Execution was listed before Justice Yogesh Khanna and the Bench has also indicated that the amount should be paid otherwise the High Court will pass an order for attachment of properties of the Judgement Debtors.
Maninder Singh appeared on behalf of Kal Airways and Kalanithi Maran and said that SpiceJet and Ajay Singh are habitual offenders for not complying with the orders passed by the Supreme Court and by this Court.
Singh further submitted that the reply to the affidavit of assets and weekly collection of Spicejet has been filed on 6 September 2023 wherein it is submitted that due to non-compliance by Spicejet and Ajay Singh, they do not deserve a right to be heard.
Amit Sibal on behalf of SpiceJet and Ajay Singh, submitted that the judgment debtors could not deposit the amount of 37.5 crore because of the bank holidays, and they are ready to hand in the cheque right now. Sibal also requested the court to grant them 3 weeks’ time to file a rejoinder to the reply filed by Kal Airways and Kalanithi Maran.
The High Court directed Spicejet and Ajay Singh to make the RTGS transfer before 04:00 p.m. by 12 September 2023 and directed the same to file a rejoinder within 2 weeks.
The High Court further directed Kal Airways and Kalanithi Maran to file their affidavit as per the order dated 4 November 2020 to obtain the affidavit filed on behalf of Ajay Singh in sealed cover and listed the matter next on 3 October 2023.
